Welcome to Pak Drive! These Terms and Conditions (“Terms”) govern your use of the Pak Drive mobile application (the “App”) and all services provided by Pak Drive (collectively, the “Service”). By using Pak Drive, you agree to be bound by these Terms.
1. General Provisions
1.1 Eligibility: To use Pak Drive, you must be at least 18 years old and have the legal capacity to enter into binding agreements.
1.2 Acceptance of Terms: By accessing or using the App, you agree to abide by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App or Service.
1.3 Changes to Terms: Pak Drive reserves the right to modify these Terms at any time. Any changes will be effective upon posting on the App. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Account Registration
2.1 Account Setup: To use Pak Drive as a driver or passenger, you must create an account. All information provided must be accurate, complete, and kept up-to-date.
2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account.
2.3 Account Termination: Pak Drive reserves the right to suspend or terminate accounts for any reason, including but not limited to breach of these Terms or misuse of the Service.
3. Services Overview
3.1 Ride Services: Pak Drive connects passengers with drivers for transportation services. Pak Drive does not provide transportation itself and is not liable for any incidents occurring during rides.
3.2 Fares: Drivers set their own fares, which passengers must agree to before beginning a ride. Pak Drive does not set or regulate fares and does not charge commission from drivers.
3.3 Ride Agreement: When a passenger accepts a ride, a direct agreement is made between the passenger and the driver. Pak Drive serves only as an intermediary platform for connecting the parties.
4. Driver and Passenger Responsibilities
4.1 Driver Obligations:
Maintain valid driver’s licenses, insurance, and vehicle registration.
Follow all applicable traffic and safety laws.
Ensure vehicles are in safe operating condition.
Conduct rides professionally and respect the rights and safety of passengers.
4.2 Passenger Obligations:
Treat drivers and vehicles with respect.
Pay the agreed fare in full at the end of the ride.
Comply with all applicable laws and regulations during the ride.
4.3 Prohibited Activities: Users are prohibited from engaging in illegal activities, harassment, or any conduct that disrupts the Service or endangers others.
5. Payment and Fees
5.1 Fare Payments: Passengers agree to pay drivers the fare amount established at the beginning of the ride. All payments are made directly between passengers and drivers, and Pak Drive does not facilitate or hold any funds.
5.2 Service Fees: Pak Drive does not charge any commission to drivers. However, Pak Drive reserves the right to introduce fees or modify fee structures in the future, with adequate notice to users.
6. User Content and Conduct
6.1 User-Generated Content: Users may post reviews or feedback on the Service. Users are solely responsible for any content they submit and agree not to post abusive, offensive, or defamatory content.
6.2 Right to Remove Content: Pak Drive reserves the right to remove or moderate content that violates these Terms or is deemed inappropriate.
7. Limitation of Liability
7.1 Service Limitation: Pak Drive is a platform that facilitates connections between drivers and passengers. Pak Drive is not liable for any incidents, damages, or disputes arising from rides or interactions facilitated by the Service.
7.2 No Warranty: Pak Drive provides the App and Service “as is” and does not guarantee uninterrupted or error-free operation.
8. Indemnity
Users agree to indemnify and hold Pak Drive, its affiliates, employees, and agents harmless from any claims, damages, or expenses arising out of their use of the Service, violation of these Terms, or infringement of third-party rights.
9. Privacy Policy
Your privacy is important to us. Please refer to our Privacy Policy, which explains how we collect, use, and share your information. By using the Service, you consent to the collection and use of your information as outlined in the Privacy Policy.
10. Governing Law and Dispute Resolution
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Pakistan.
10.2 Dispute Resolution: Any disputes arising out of or related to these Terms shall be resolved through arbitration in Islamabad, Pakistan, per Pakistani arbitration law.
